Terms of Service

These Terms of Service (“Terms”) contain the agreement between you and Artera with respect to Artera described below. Please read these Terms carefully as well as our Privacy Policy.

These Terms of Service constitute an agreement between you and Artera LTD. When you create an Artera account or use Artera, you form a contract with us accepting these Terms.

In short: This is a contract between you and Artera. You should read it.

1. What services are covered by these Terms

These Terms govern your use of Artera services (the “Platform”), which includes the Artera app, websites, software and related services, accessed via any platform or device. The Artera Community Guidelines also form part of our contract with you, and by agreeing to these Terms, you confirm to us that you will comply with them.

2. Using Artera

Our Platform and business model

We are the companies affiliated with us (“Affiliates”) provide Artera for all, so everyone can use it, in a growing list of languages worldwide.

Artera allows you and others to create, view, interact with and share content, compile your own and others content into collections, publicly and privately, and interact with others in a multimedia context. We also personalise your experience on Artera, such as providing your own “Discover” page, which will continue to show you content based on what we have determined could be interesting and engaging for you to discover.

We want Artera to be a safe and inspiring place, where you can be who you are and have fun. We work with our Affiliates and use a combination of technology, through automation, human moderation and user identified reports of infringements of these Terms and our Community Guidelines in order to ensure yours, and all of our users’ protection.

You do not have to pay a fee to use most of the features on Artera. Mostly, businesses and organisations pay us to show you ads for their products and services, and we may also charge sellers a commission on products sold in the future. A Premium subscription will offer additional features such as increased limits and cosmetic improvements, however this can be attained through monthly payment, patronage to other creators or our referral system.

Information on how we use data that we collect about you can be found in our Privacy Policy. This does not form part of this contract, but is an important document that we strongly recommend that you read.

We charge users for some features of Artera, for example, if you buy a virtual gift but all of these features are voluntary and any costs are clearly outlined prior to purchase.

Account details

You can use some basic features of Artera without having an account. If you use Artera without an account, then these Terms will still apply to such use and we will still process your personal data in accordance with our Privacy Policy.

To access the full functionality of Artera, you require an account with us. We may offer different types of accounts, including but not limited to User, Artist, Institution and Tester accounts.

When you create an account to access and use Artera, you don’t have to disclose your identity, but you must provide accurate and up-to-date information about yourself (including your date of birth). You may not impersonate someone or something you aren’t, and you can’t create an account for someone else unless you have their express permission.

It is important that you take reasonable steps to keep your account password confidential and that you do not disclose it to any third party. If you know or suspect that a third party knows your password or has accessed your account, please ensure to change it right away.

Minimum age

You can only use Artera if you are 13 years of age or older. We monitor for underage use and we will terminate your account if we reasonably suspect that

What you can do on Artera

We agree to provide you with the Artera Service. The Service includes all of the Artera products, features, applications, services, technologies, and software that we provide to advance Artera’s mission: To truly make art accessible and for all. Under these Terms, you can use Artera to:

  • Create, discover, connect, collect and share content; Everyone is different. We offer you a suite of features that can be tailored for you to help you create and share content, discover and collect content of other users and creators, connect with communities that you resonate with and grow your presence. We offer you the opportunity to satisfy your curiosity, discover your desires and share experiences on Artera.
  • Interact with other users and creators; We offer a truly multi-media, immersive experience allowing you to interact with other users and creators through our many features - there is something for everyone. We develop tools to encourage positive and inclusive interactions and experiences for our community, and work to combat abuse and hate as well as any breach of our Terms.
  • View and listen to content created by others; Artera is constantly analysing and processing the content that you view and listen to in order to ensure a state-of-the-art, personalised experience as well as to improve our Service for a broad global community. Artificial intelligence and machine learning techniques are leveraged to ensure functionality and integrity of the Artera Service.

The permission we give to you:

  • Is limited to what we have said we allow in these terms;
  • Is only for you;
  • Cannot be transferred to anyone else by you;
  • Can be withdrawn for the reasons stated in these Terms.

Access to certain features of the Platform depends on your age. For example:

  • Audio Commenting: You must be aged 16 or older to use the audio comment posting functionality.

What you can’t do on Artera

Our Community Guidelines apply to all users and content on Artera. If you want to use Artera, you can’t create, post, share, link to or otherwise interact with content in breach of our Community Guidelines.

You must not use Artera to:

  • Do anything illegal;
  • Negatively impact the enjoyment of other users;
  • Engage with minors in an exploitative or inappropriate way;
  • Undermine Artera’s operations or security;
  • Extract any data or content from Artera using any automated system, scraper or software; or
  • Use or attempt to use another user’s account without authorisation.

You also must not post, comment or otherwise distribute any content on Artera that:

  • Infringes anyone else’s rights (such as intellectual property, privacy and/or personality rights of living or deceased people);
  • Constitutes, encourages or provides instructions for unlawful, misleading, fraudulent or for an illegal or unauthorised purpose;
  • Spreads harmful misinformation such as misinformation that incites hate or prejudice;
  • Contains a threat of any kind or which intimidates or harasses others, including posting any material that is intended to humiliate, intimidate or hurt an individual;
  • Is pornographic, hateful or inflammatory or which promotes sexually explicit material such as linking to adult or pornographic websites;
  • Contains or promotes violence or discrimination based on race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender identity, serious disease, disability, immigration status or age; or
  • Otherwise contains harmful content.

We respect copyright and intellectual property rights. You can report suspected infringements of intellectual property rights on Artera.

You can also report any suspected illegal content or content that breaches these Terms or our Community Guidelines through the reporting functionality provided on Artera (long-press on most items or by using the context menu).

Your content

It is important you understand what happens to any content that you create, post or share on Artera, including posts and comments:

  • You are solely responsible for the content that you make available on Artera and you should ensure that you have all of the rights needed to create, post or share said content on Artera.
  • We may remove or restrict access to any content, including yours, if we believe that it is in breach of these Terms or our Community Guidelines; and/or it causes harm to us, Affiliates, our users or other third parties.
  • You are free to remove your content from Artera at any time.
  • If other users of Artera have used your content to create additional content, such as Audio or Text comments, then that new content may stay on Artera, even if you subsequently delete your content or your account. You may make a separate request for Comment-tied content that contains your content to be deleted.
  • You can restrict how other users interact with and use your content in the Artera settings page, available from your profile. Privacy settings also apply.

Content ownership and grant of licences

We do not claim ownership of your content, but you grant us a licence to use it on Artera. Nothing changes regarding your rights in your content. We do not claim ownership of any content you post on Artera and are free to share your content with anyone else, wherever you choose.

To provide Artera, we need certain rights from you (called a licence). The details of the licence are set out below.

When you create, post or share content that is covered by intellectual property rights, on Artera, you hereby grant to us a:

  • Non-exclusive (which means you are free to licence your content to others),
  • Royalty-free (which means that we don’t pay you for this licence),
  • Transferable (which means that we can give the rights you give us to someone else),
  • Sub-licensable (which means that we can licence your content to others, e.g. service providers that help us provide Artera or to trusted third parties that have entered into contractual agreements with us to operate, develop and provide Artera) and
  • Worldwide (which means that the licence applies anywhere in the world)

Licence to use your content, including to reproduce, adapt or make derivative works (e.g. to translate and/or create captions, extract key subjects and objects for our subject-object detection feature, highlight subjects and objects when tagged), perform and communicate that content to the public (e.g. to display it) for the purposes of operating, developing and providing Artera, subject to your Artera settings.

The licence that you grant us extends to Affiliates as part of making Artera available.

Your licence to Artera ends when you close your account or when you or we remove your content from Artera in accordance with these Terms or our Community Guidelines. However due to the nature of Artera and our legal obligations, the licence granted will continue after you have removed your content to the extent that:

  • You have allowed, via your Artera settings, other users of Artera to use or reuse your content (e.g. Text and Audio comments, download or share functionalities); or
  • We are obliged to store or process your content for legal reasons.

If you choose to submit comments, ideas or feedback, you agree that we are free to use them for the purposes of operating, developing, improving and providing Artera without compensation to you.

What we promise to you

We promise to provide Artera to you with reasonable skill and care and to act with professional diligence for as long as we choose to offer Artera. We will take all reasonable steps to keep Artera a safe and inclusive environment for our users. We do not promise to offer Artera forever or keep it in its current form for any particular period of time.

The content on Artera is mostly user-generated content or provided by third party business users.
